Terms of Service

These Terms ("Terms") are an agreement between You and OriginMind Inc. ("moonbelt", "We", "Us", "Our") governing Your use of the moonbelt mobile application and related services (the "Service"). By using the Service, You agree to these Terms and Our Privacy Policy.
US residents: please read Section 16 (Arbitration) carefully. It affects Your legal rights.
1. Definitions
- Application: the moonbelt mobile app and all related features and updates.
- Service: the Application, website, and any related services offered by moonbelt.
- User Content: meal logs, photos, notes, and other content You submit through the Service.
- You: the individual using the Service.
2. Agreement to Terms
By accessing or using the Service, You confirm that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must stop using the Service.
3. Eligibility
You must be at least 13 years old to use the Service. By using the Service, You represent and warrant that You are 13 or older. The Service is not directed to children under 13.
If You are between 13 and 17 years old (or under the age of majority in Your jurisdiction), You may use the Service only with the consent and supervision of a parent or legal guardian who has reviewed and agreed to these Terms and who agrees to be responsible for all activities conducted through Your account. Parents and guardians of teen users should review the Medical and Wellness Disclaimer in Section 4 before permitting use.
You should not use the Service if You are pregnant or nursing, have or are recovering from an eating disorder, or have a medical condition requiring a supervised diet, unless a physician has approved Your use.
4. Medical and Wellness Disclaimer
moonbelt is not a medical device and does not provide medical advice, diagnosis, or treatment. Calorie targets, macro splits, meal suggestions, meal plans, food scores, and AI coaching content are for informational and educational purposes only, not a substitute for professional medical or nutritional guidance.
Meal plans and allergies. Meal plans are generated automatically by AI and may include foods that conflict with Your allergies, intolerances, medical conditions, or religious or ethical dietary requirements. You are responsible for reviewing every meal plan before acting on it and for confirming that each food and ingredient is safe and appropriate for You. Do not rely on a meal plan to avoid an allergen or to manage a medical condition. If You have a food allergy or a condition requiring a controlled diet, consult a qualified professional before following any plan.
Consult a physician or registered dietitian before making significant dietary changes, especially if You have a medical condition, are pregnant or nursing, or have a history of disordered eating. Results vary; moonbelt makes no guarantee of weight loss or any health outcome.
5. AI Features
moonbelt uses third-party AI to recognize food from photos, parse voice meal logs, generate coaching responses, and create personalised meal plans. AI output can be inaccurate or incomplete and may suggest foods that are unsuitable for You. Always review AI output, including every item in a meal plan, before relying on it. AI content is educational, not medical advice.
6. Nutrition Data, Sources, and Accuracy
Nutritional information in the Service, including calories, macronutrients, micronutrients, serving sizes, and other values, is provided for general informational purposes only. It is drawn from a combination of third-party databases, public data sources, AI estimation, and information You enter.
Data sources and attribution. moonbelt's nutrition information is derived in part from the following sources:
- USDA FoodData Central, provided by the U.S. Department of Agriculture and made available in the public domain. moonbelt is not endorsed by, sponsored by, or affiliated with the USDA.
- Open Food Facts, a collaborative, community-maintained database. Open Food Facts nutrition data is used under the Open Database License (ODbL), and product images (including those shown when You scan a barcode) are used under the Creative Commons Attribution-ShareAlike (CC BY-SA) license. moonbelt is not endorsed by or affiliated with Open Food Facts. © Open Food Facts contributors.
These sources are maintained by third parties, may contain community-contributed entries, and may be incomplete, outdated, or inaccurate.
Accuracy. We do not warrant or guarantee the accuracy, completeness, or reliability of any nutritional data, food score, calorie estimate, serving size, or portion estimate, whether sourced from a third-party database, generated by AI from a photo, voice input, or barcode, or otherwise. Values derived from photos, including identification of foods and estimation of quantities or portion sizes, are approximations and may differ significantly from actual values. You are solely responsible for evaluating the accuracy, completeness, and suitability of all nutritional information before relying on it, including verifying packaging labels, ingredients, and allergen information directly from the product or its manufacturer. You use the Service, and make dietary, nutritional, and health decisions, at Your own risk.
7. Food Score and Ratings
The Service may assign a "food score," rating, or similar indicator to foods and products. Any such score:
- is an opinion generated by a proprietary methodology based on general nutritional models and the data available to Us, and is provided for informational and educational purposes only;
- is not medical, dietary, or nutritional advice, and is not a statement that any food is "safe," "unsafe," "healthy," or "unhealthy" for You specifically;
- is not an endorsement, certification, recommendation, or disparagement of any food, brand, manufacturer, or product; and
- may not reflect Your individual health conditions, allergies, dietary needs, or goals.
Scores are general and may change as data, methodology, or Your profile changes. Different foods may suit different people; a score is a simplified summary and not a substitute for reading labels or consulting a qualified professional. You should not make purchasing or dietary decisions based solely on a food score.
8. Subscriptions and Billing
Subscriptions are billed through the Apple App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
Free trials. If We offer a free trial, Your subscription begins as a free trial and automatically converts to a paid, auto-renewing subscription at the end of the trial unless You cancel at least 24 hours before the trial ends. Payment is charged to Your App Store or Google Play account at confirmation of purchase or at the end of the trial. If You purchase a subscription during a free trial, any unused portion of the trial is forfeited.
To cancel (iOS): Settings → [Your name] → Subscriptions → moonbelt → Cancel Subscription.
To cancel (Android): Google Play → Profile → Payments & Subscriptions → moonbelt → Cancel.
Refunds are governed by Apple's and Google's policies. Contact reportaproblem.apple.com (iOS) or Google Play (Android).
9. User Content
User Content remains Yours. You represent that You own or have the necessary rights to Your User Content. You grant Us a worldwide, royalty-free license — including the right to sublicense to the service providers who help Us operate the Service — to host, store, reproduce, process, analyze, and create derivative works from Your User Content in order to operate and improve the Service, including through the use of aggregated or de-identified data. We will not use Your identifiable User Content to train AI models without Your consent. This license ends when You delete Your User Content or Your account, except that it continues for (a) aggregated or de-identified data that no longer identifies You, and (b) AI improvements already made with Your consent before deletion.
10. Prohibited Uses
You may not reverse engineer the Service; use it to build or assist a competing product; copy, reproduce, or imitate the design, user interface, layout, visual appearance, or "look and feel" of the Application; scrape or automate access; use the Service or its content to train any artificial intelligence or machine-learning model; upload malware or unlawful content; or circumvent subscription or authentication controls.
11. Intellectual Property
The Service, including its source code, design, user interface, layout, graphics, animations, icons, visual appearance and "look and feel", text, the moonbelt name and logo, and all related trademarks (but excluding User Content), is owned by OriginMind Inc. and its licensors and is protected by copyright, trademark, trade dress, and other intellectual property laws. No rights are transferred to You beyond the limited license to use the Application on Your devices.
You may not copy, reproduce, modify, republish, distribute, or create derivative works from any part of the Service, nor imitate its design, user interface, or branding in a manner likely to cause confusion or to trade on Our goodwill, without Our prior written permission. Nothing in these Terms grants You any right to use the moonbelt name, logo, or trademarks.
12. Termination
We may suspend or terminate Your access for violations of these Terms. Sections 4, 6-7, 9-11, and 13-16 survive termination.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy.
14. Limitation of Liability
Our total liability for all claims is limited to the greater of (a) amounts You paid in the 12 months before the event, or (b) USD $100. We are not liable for indirect, incidental, or consequential damages, including loss of data or profits.
15. Indemnification
To the maximum extent permitted by law, You agree to defend, indemnify, and hold harmless OriginMind Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) Your access to or use of the Service; (b) Your User Content; (c) Your violation of these Terms; or (d) Your violation of any applicable law or the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by You, in which case You agree to cooperate with Our defense of that claim.
16. Governing Law and Arbitration
These Terms are governed by the laws of Ontario, Canada. Disputes involving Canadian, EEA, or UK residents will be resolved in Ontario courts.
US residents only: Disputes will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Class actions are not permitted. You may opt out within 30 days of first accepting these Terms by emailing legal@moonbelt.ai with subject line "Arbitration Opt-Out."
17. Apple App Store: Additional Terms
These additional terms apply when You download the Application from the Apple App Store. You and We acknowledge that these Terms are concluded between You and OriginMind Inc. only, and not with Apple Inc. ("Apple"). OriginMind Inc., not Apple, is solely responsible for the Application and its content.
- Scope of licence. The licence granted to You for the Application is a non-transferable licence to use it on any Apple-branded device that You own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. OriginMind Inc. is solely responsible for providing any maintenance and support for the Application. Apple has no obligation to furnish any maintenance or support services.
- Warranty. OriginMind Inc. is solely responsible for any product warranties, whether express or implied. If the Application fails to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price (if any) of the Application; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application.
- Product claims. OriginMind Inc., not Apple, is responsible for addressing any claims by You or any third party relating to the Application, including (a) product-liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.
- Intellectual property. In the event of any third-party claim that the Application or Your use of it infringes that third party's intellectual property rights, OriginMind Inc., not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that You are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon Your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against You as a third-party beneficiary.
- Contact. Any questions, complaints, or claims regarding the Application should be directed to support@moonbelt.ai.
18. Changes to These Terms
We may update these Terms at any time. Material changes will be announced through the app or by email before taking effect. Continued use constitutes acceptance.
